IMPORTANT: Effective May 7, 2013, Employers Must Use New Form I-9 for New Hires


USCIS has published a new version of Form I-9, which is the form that employers are required to complete and maintain on file for all employees who were hired on or after November 7, 1986, pursuant to the Immigration Reform and Control Act of 1986 ("IRCA”).  Beginning May 7, 2013, all Employers are required to use the new version of Form I-9 for all new hires and must not use any older versions of Form I-9.

The new Form I-9 bears a date of "03/08/13” in the lower left-hand corner of the Form and has gone from one to two pages. The Form can be found on the website of the U.S. Citizenship and Immigration Services at www.uscis.gov/files/form/i-9.pdf.  Failure to use the new form I-9 and to otherwise comply with the requirements of IRCA can lead to fines and penalties being assessed against employers and the individuals responsible for completion of the Forms I-9.
